           Existing law permits three units per parcel (i.e. single-family home, ADU + junior ADU) in a residential neighborhood. Beginning January 1, 2022, SB 9 (Atkins) establishes a streamlined approval process for single family residential lots which meet the specified requirements of the bill to be converted to duplexes and for owner occupants of property who agree to reside in their property for three years, to split their lots (assuming requirements of the bill are met) and build up to two additional units. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
            
           &#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           SB 10 (Wiener) Planning and Zoning
            &#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           This law empowers local governments to exempt projects, 10 units or less, from any additional CEQA review if the parcel is located in a transit-rich area, jobs-rich area, or an urban infill site. It requires developers to follow all local objective design criteria, local impact fees, local height and setback limits, and local demolition standards. SB 10 specifically prohibits projects from accessing streamlined approvals if the project is located in a HOA, high fire severity zone, state or national historic district, or requires the demolition of rent controlled units.  
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
            
           &#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;

           AB 1174 (Grayson) Development Application Modifications
            &#xD;
      &lt;br/&gt;&#xD;

    &lt;span&gt;&#xD;
      
           This law will require local governments to consider the application for subsequent building permits based on the objective standards and building codes that were in effect when the original development application was submitted. Additionally, it will provide that a development or modification’s approval is valid for 3 years from the date of the final judgment upholding the development or modification’s original approval if litigation is filed challenging that approval.

           What is Blockchain ?

            Blockchain, Blockchain, Blockchain.  We hear it, but what does it mean.  Simplist version,  it's blocks of information that create a chain.  It's a final record that can not be changed.  It's intended to keep everyone honest and it's not perfect, but human error is higher and suseptible to emotion.  It's a different way of organizing  large databases of information. 
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           In relationship to #CRE it's a transactional solution that is decentralized or negates third parties. Could it elimate CRE Brokers?  Well,  buyers and sellers need to be introduced, so not initally.  One of the most exciting aspects of blockchain and #CRE is the expanded ability for buyers to participate at a non-corporate level of finance. There is more to come. #CRE using blockchain and smart contracts is in it's infancy.

           You have a capital gain on an investment and now you need to make a decision about whether or not to defer your  capital gains.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           You can do a 1031 exchange and you can opt for an opportunity zone fund.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Some commercial real estate search engines, will clearly show the "opportunity zone" (OZ) investment properties.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            You can't just pick up a OZ property and receive benefits. You need to invest in a OZ fund or create your own. 
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           The taxes rules on this are extensive, so you need to love your CPA, but tax deferments might be worth it. The deferements are good until 2026.  You may have holdings past 2026 and see tax benefits.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Your tax basis on an OZ fund starts at zero and if it's held for 5 years, the tax basis goes up 10% and if it's 7 years the basis goes up another 5%. If the investment is held for 10 years, the tax basis can be reset to fair market value of the qualified opportunity fund. If this happens there isn't a tax on the gain. 
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Talk to your CPA if your interested in these investments. 
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;

           I’ve brokered real estate auctions for years and recommend it, for the right people in the right situation. Although not as prevalent in the western states, the rest of the country seems pretty comfortable with real estate auctions.
          &#xD;

           Auctions are great at bringing people to the table, no distractions and no bull shet. Yet, there are details such as the buyer's premiem that are very important.

    &lt;br/&gt;&#xD;

           As a seller, you’re committed to terms and conditions and as a buyer, better throw down your wallet or you lose, ouch! It’s an efficient way to do business. Get the job done and move on to the next investment. Marketing is important.

  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;

           Sellers: Auctions are great so you can move forward with new deals. In a slow market, your afraid the real estate might sell for more later, well maybe … but you’ve got 200K in carrying costs per year that should be considered! In a hot market, your afraid of, well nothing...competitive bidding rocks! Hot markets are when auctions thrive.

           Buyers: Afraid you might pay too much, don’t be. A property is worth what a buyer is willing to pay. Value is perception. 5 million might be a deal to you and too much for the other buyer. Don’t wait, register and be ready to lift that bid PADDLE at any opportunity!
